Purpose
The proposed amendment to rule 60Y-5.006(4) updates an F.A.C. cite; and 60Y-5.006(10) adds that a frivolous complaint or a complaint filed by a vexatious litigant may be administratively dismissed.Summary
Provides for the administrative dismissal of a complaint filed by a person who meets the definition of vexatious litigant.Regulatory Costs
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the economic review conducted by the Agency.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

FULL TEXT OF THE PROPOSED RULE
60Y-5.006 Administrative Dismissal of a Complaint.
The Executive Director, on behalf of the Commission, shall dismiss a complaint upon one or more of the following grounds:(4) Anytime after the expiration of 180 days from the date of filing the complaint when a Determination of Reasonable Cause or No Reasonable Cause has not been issued by the Commission, and the complainant has failed to file a Petition for Relief pursuant to paragraph 60Y-5.008(1)
(5) through (8) No change.
(9) There is no jurisdiction over the respondent or subject matter of the complaint;
(10) The complaint is frivolous on its face or the complaint was filed by a vexatious litigant.
