Section 459.016(3), F.S. Records of a medical organization taking disciplinary action against an osteopathic physician which have been furnished to the Department of Health for the purpose of disciplinary proceedings shall be confidential and exempt from s. 119.07(1). Section 459.017(3), F.S. Medical reports pertaining to the mental and physical condition of osteopathic physicians which are maintained by the Department of Health pursuant to this section shall remain confidential and exempt from s. 119.07(1) until probable cause is found and an administrative complaint issued. Section 459.018, F.S. Patient medical records obtained during a search of an osteopathic physician’s office by the Department of Health pursuant to this section are confidential and exempt from s. 119.07(1).
