JUDGE BOWMAN’S SPECIAL SET DOCKETS WILL BE AVAILABLE ON THE CMS SYSTEM BEGINNING IN 2023. Our office will no longer be accepting requests for special settings unless there is approval by Judge and time permits.

Pursuant to AOSC20-23 - all cases that are at issue and in excess of 18 months will be set for trial. The court will strictly be enforcing time standards.

UMC is 5 minutes only - Mon - Thurs - 8:45 AM - 9:30 AM - (Judge will stop hearing motions at 9:30 AM) - Two (2) motions on the same case per motion calendar may be set simultaneously - if not scheduled in this manner hearings will be subject to cancellation without notice.

NO ADD-ONS OR CROSS NOTICES PERMITTED.

ALL HEARINGS and TRIALS MUST BE COORDINATED BY THE PARTIES, OR WILL BE SUBJECT TO CANCELLATION WITHOUT NOTICE. NO EXCEPTIONS. IF PARTIES CANNOT AGREE TO COORDINATE - THE COURT WILL SET IT DOWN UNILATERALLY. COURT ORDERED HEARINGS ARE JUST THAT - COURT ORDERED.

PAPERWORK MUST BE MAILED IN & BE IN THE JUDGES OFFICE 7 TO 10 DAYS PRIOR TO HEARING;

Judge Bowman does not participate in efiling, therefore -

Submission is done via US Mail, FedEx, UPS or hand-delivery.

LOCAL RULE 01 | CASE MANAGEMENT CONFERENCE

Case Management Conferences must be requested in writing and mailed out. Your case will be set for trial by the Court at Case Management Conference.

SPECIAL SETS - JUDGE BOWMAN’S SPECIAL SET DOCKETS ARE AVAILABLE ON THE CMS SYSTEM. All hearings are to be coordinated with opposing counsel. Only one time slot can be reserved for motions, per day, per case, for example:

If 3 motions need to be set and the parties agree on a day and that 45 minutes is sufficient time for the 3 motions, then the parties may schedule a 45 minute time slot for the 3 motions on the day agreed to.

Hearings not scheduled in this manner – will be subject to cancellation without notice.

If a special set hearing or a UMC hearing has been scheduled in your case, and your case settles or a dismissal has been entered, you must go onto the CMS system and cancel your hearing(s) so that the time slot(s) can be made available to another case. This is a fairness issue and we thank you for your cooperation.

LOCAL RULE 02 | HEARINGS

WE DO NOT CONFIRM HEARINGS.

PROPOSED ORDERS: Hard copies of proposed orders are to be mailed to the Judge - you must submit an original along with the amount of copies for each attorney, as well as stamped self-addressed envelopes for each attorney with accompanying cover letter. If the packet is incomplete, it will be sent back.

PENDING ORDERS: WE DO NOT CONFIRM STATUS OF ANY PENDING ORDERS.

AGREED ORDERS or Orders reflecting the ruling of the Court as agreed by both sides can be uploaded to the Judge’s workbench on the CMS system. PLEASE DO NOT CALL OR EMAIL AS TO THE STATUS OF THE SIGNING OF AN ORDER.

LOCAL RULE 03 | MOTIONS

MOTIONS WILL NOT BE HEARD AT CALENDAR CALL

Emergency motions must be delivered to Judge Bowman's chambers for consideration; or refer to the emergency Administrative Order 2021-50-Civ. or call Court Administration 954-831-7043.

EMAIL COMMUNICATION IS LIMITED TO SETTLED CASES ONLY - You may email agranata@17th.flcourts.org with a copy of the filed dismissal, along with the date of trial docket, and any upcoming hearings including case management; and it will be removed from the docket.

I received a Case Management order for my case, do I need to attend?

Yes.

Failure to attend can result in dismissal or other sanctions. If you have received a cmc hearing and the case was dismissed/settled/closed/filed bankruptcy, etc., please upload an Agreed Order of Dismissal through the Judge’s workbench on CMS. Upon signage from the Judge, you will be provided with an email alert regarding the same and your CMC hearing will be cancelled.

Settlements - If your case has settled, counsel must contact the Judges office upon a settlement prior to calendar call - this may be done via tele or email - so that the case may be taken off the docket.

LOCAL RULE 04 | TRIALS

IF YOUR CASE IS ON A TRIAL DOCKET, IT CAN BE CALLED AT ANY TIME DURING THE TRIAL PERIOD REGARDLESS OF BACK-UP STATUS - WITH AN HOUR’S NOTICE TIME. PRE-TRIAL STIPS MUST BE FILED WITH COPY TO OUR OFFICE PURSUANT TO PROCEDURES HEREIN.

CALENDAR CALL DOCKETS will be sent out via email prior to calendar call. Please bring/have them with you during calendar call so as to keep track of your case as well as the cases before yours. PLEASE DO NOT CALL THE JA TO FIND OUT WHERE YOUR CASE STANDS ON THE DOCKET - this is why you receive a copy of the trial docket so as to keep track of your case. Any calls relative to this case will be redirected to these procedures.

LOCAL RULE 05 | MOTIONS TO WITHDRAW

Please submit motion, client’s consent and copies of proposed orders mailed to the Judge - accompanying cover letter. If client does not consent, motion must be set down for hearing.

LOCAL RULE 06 | EX PARTE

Ex Parte Orders must conform to local rule 10 –

May be submitted via CMS online service. Order must state that other party has “completely failed to respond or object to discovery or seek an extension to respond”. Order must strictly comply with rule 10.

Motions to approve minor settlements – Agreed Orders submitted to CMS system:

LOCAL RULE 07 | PETITIONS

Petition must include:

1) Names, residence address and date of birth of the minor;

2) The name and address of any Guardian Ad Litem appointed for the minor;

3) The names and addresses of the natural guardians or other persons having legal custody of the minor;

4) The consent of the natural guardians or other persons having legal custody and authority to act upon behalf of the minor child;

5) A statement disclosing the interest of any natural or court-appointed guardian whose interest may be in conflict with that of the minor;

6) A description of the cause of action in which the minor’s interests arises;

7) A summary of the terms of the proposed settlement;

8) The proposed distribution of the net proceeds in conformity with Florida Law;

9) Copies of all agreements, releases, closing statement or other documents to be executed on behalf of the minor;

10) The report of the Guardian Ad Litem, if any;

11) A statement stating whether it is believed to be in the minor’s best interest for this settlement to be entered;

THE ABOVE ITEMS MUST BE INCLUDED IN THE PROPOSED ORDER; OR BE SET FOR HEARING.

For Hearings Requiring Court Reporters: Parties who desire a Court Reporter will make the necessary arrangements with the Court Reporter to appear telephonically by ZOOM at special set hearings.

The Court Reporter will announce their presence.

Any witness(es) or interpreter will announce their presence, the attorneys must ensure a person authorized to give oaths is present. See Supreme Court of Florida, Administrative Order No. AOSC20-16.

LOCAL RULE 09 | ANNOUNCEMENTS

ANNOUNCEMENT DIRECTED TO ALL PERSONS APPEARING BY TELEPHONE OR VIDEO CONFERENCE:

In times like these the need for professionalism is even more paramount. Many of us are experiencing multi-party telephonic and video hearings for the first time.

PLEASE:

1) Be considerate and let others finish making their arguments/thoughts without interruption before responding.

2) State your name when you begin to speak, especially in multi-party hearings and when a court reporter is in attendance.

3) Please be patient, the Court is attending to multiple matters at the same time.

4) Mute your phone and please be mindful of background noise when you are not speaking.

5) When attending hearings via ZOOM, please remember that you are on camera and everyone involved can see you. If you do not want to be seen you can click on the icon to just attend via audio.

Thank you for your cooperation. We hope you and your families remain healthy and stay safe.

No double bookings, “back to back” hearings, or space the hearing throughout the day in several time slots is allowed. You can book (motion(s)) only one case per day on the Special Set calendar. This is a fairness issue. There are many cases per division and limited resources, so each limits the “taking” of time slots. Violations are subject to sanctions and subject to cancellation by the court without notice.
