This rule is to be repealed. There will be no adverse effect on the public.

Summary

Rule 60Y-2.004, F.A.C. reiterates the requirements found in Rule 28-101.001, F.A.C.

Regulatory Costs

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein:
The proposed rule repeal is to a procedural rule and will have no economic impact, and therefore, will not require ratification. There are no applicable federal standards that relate to Rule 60Y-2.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(2) This chapter shall not apply to Complaints (Rule 60Y-5.001, F.A.C.); Agreements for Referral of Complaints (Rule 60Y-5.002, F.A.C.); Investigation of Complaints (Rule 60Y-5.003 60Y-4.004, F.A.C.); Conciliation (Rule 60Y-5.005, F.A.C.); Administrative Dismissal (Rule 60Y-5.006, F.A.C.); except as provided in subsection (3).

(3) The provisions of Rules 60Y-4.006, 60Y-4.007 and 60Y-4.008, F.A.C., shall apply to all rules enumerated in Subsection (2).

(3)(4) When a proceeding pursuant to Chapter 60Y-5, F.A.C., of the rules of the Commission is before a Panel, the term “Commission”, when it appears in this chapter, shall include that Panel, if the context so requires.

Purpose

The proposed rule amendment seeks to fix a transposed statutory citation and remove an outdated reference.

Summary

The proposed rule seeks to outline the statutory and regulatory authority of the Commission.

Regulatory Costs

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein:
The proposed rule amendment is to a procedural rule and will have no economic impact and, therefore, will not require ratification, There are no applicable federal standards that relate to Rule 60Y-2.006, F.A.C.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

Purpose

The proposed rule amendment seeks to correct an inconsistency between the rule and the statute.

Summary

Section 760.11(1), Florida Statutes, indicates that answers may be filed with the Florida Commission on Human Relations within 25 days of the date the complaint was filed with the Commission, not within 25 days of the notice of filing. This amendment would correct this inconsistency.

Regulatory Costs

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein:
The proposed rule amendment is to a procedural rule and will have no economic impact and, therefore, will not require ratification. There are no applicable federal standards that relate to Rule 60Y-5.0011.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

Notification

IF REQUESTED WITHIN 21 DAYS OF THE DATE OF THIS NOTICE, A HEARING WILL BE SCHEDULED AND ANNOUNCED IN THE FAR.
